my stinger gt(purchased demo a month ago) has faulty with the battery atm and it goes flat every single day. Been service twice and same issue still happen.
In that case, can i replace or refund my car in nsw australia?
 
Take it to the dealer, it’s a month old & they will replace the battery.
No car manufacturer with replace or refund you for a battery issue, this has been documented here before & I’m sure a battery replacement has resolved the issue you describe.
 
Australia has great consumer protection laws in general (especially when compared to other markets), but one thing we do lack here is good Lemon Laws for cars.

That said, as @Stinger GT SS mentioned, there's a known issue with some cars suffering this due to a faulty battery - get Kia to replace the battery, and see how things go.

If that doesn't fix it, then talk to Kia - they've replaced cars due to bad paint (the Yellow cars in particular appear to have had bad paint) in the past, so they're not above making sure their customers are happy. But you will have to do the right things by them - starting with telling your dealership that the problem persists, and you'd like the battery replaced entirely as part of their troubleshooting.

Sorry, not catching your drift here.

Our posts are consistent with reality. Unfortunately, it isn't a case where if you don't like this reality, you get to choose another.

Unless the dealership has replaced the battery (your posts don't seem to indicate that they have, but maybe we're misreading you), then that's the best course of action for you now - tell them that the battery is dead every day and you want it replaced.

If they refuse, call Kia and tell them the story. If the issue isn't with the battery, and they have lots of trouble fixing it, you will, under Australian consumer protections, have a reasonable case for replacement of the car- but if Kia don't come to the party (if, for instance, you don't get your way and get shouty at people who are only trying to help instead of helping yourself and following a reasonable process), then, unfortunately, no matter what we say here, Australia hasn't got strong Lemon Laws, and you may struggle to get satisfaction.

Kia do have a better reputation here though that other manufacturers such as Jeep (Man who destroyed Jeep Cherokee helps dissatisfied new-car owners to tune of $2m - ABC News (Australian Broadcasting Corporation)) and Ford (who the ACCC had to step in on - Ford Powershift transmission problems: $10 million fine).
