A defect from factory? Man down

My mechanic thinks this screw and bushing was never put on unless i was worked on/used vehicle before. I got it off the showroom floor so it isnt used, trans and diff serviced a couple months ago. I asked my mechanic friend, but he said they would never need to touch these bolt for that. With all of that said, how would I go about asking for the dealership to cover for it? The car was modified so I'm already in the negative, I have third party insurance, but I would rather try the warranty option. What do you guys think? Thoughts? I launched it and this happened basically.

its the 1.3 bar lozic tune. Since the new ECU, I added a Agency Power bolt on intercooler and got a custom dual exit catback, I have intakes. I hope I am close to assume 400HP at the crank. I was getting ready to do a lozic dyno tuning session after I did the catless & coils upgrade...Gotta wait now haha.
